PREAMBLE

These “General Conditions of Sale” apply to legal operations relating to products marketed to its customers by Phone Parts Online within its internet store.

DEFINITIONS:

The following words or expressions will have the following meaning in the context of these terms:

Internet Store: refers to the Phone Parts Online website on which the Products are presented and sold to customers.

Order: designates the sales contract concluded between Phone Parts Online and the customer of the Phone Parts Online internet store.

Product sheet: refers to the classified information concerning a product provided by Phone Parts Online when said product is put on sale in its internet store.

Product(s): refers to all the goods and services offered for sale by Phone Parts Online in its internet store.

Spare part: refers to all goods offered for sale by Phone Parts Online in its internet store.

Transaction: refers to all operations, secure processing, authorizations and agreements inherent to the payment of the price of Products ordered by credit card.

ARTICLE 1 - PURPOSE

The purpose of these General Conditions of Sale is to define the terms and conditions under which Phone Parts Online offers and sells its products to its customers.

These general conditions of sale will prevail over all other conditions appearing in any other document, unless prior, express and written waiver.

ARTICLE 2 - ACCEPTANCE OF THE CONDITIONS

The customer acknowledges having read, at the time of placing the order, these general conditions of sale and expressly declares to accept them without reservation.

These general conditions of sale govern the contractual relations between Phone Parts Online and its customer, both parties accepting them without reservation.

ARTICLE 3 - PRODUCTS

The majority of products offered by Phone Parts Online to its customers are immediately available.

However, all products marketed by Phone Parts Online may or may not necessarily be sold online.

ARTICLE 4 - ORDER

Automatic recording systems are considered proof of the nature, content and date of the order.

Phone Parts Online will confirm to the customer the acceptance of their order by sending a confirmation message to the email address that the latter has communicated. The sale will only be concluded upon sending of said order confirmation.

Phone Parts Online reserves the right to refuse or cancel any order from a customer, particularly in the event of insolvency of said customer or in the event of non-payment of the Order concerned or delivery previous order or a dispute relating to the payment of a previous order.

The information indicated by the customer when entering the information inherent to his order binds him. Phone Parts Online cannot be held responsible for errors made by the customer in the wording of the contact details of the recipient of the order (delivery address, billing address in particular) and for delivery delays or the impossibility of delivering the ordered products that these errors could occur.

ARTICLE 5 - DELIVERY

After confirmation of the order and subject to full payment of the price of the products ordered, Phone Parts Online undertakes to ship the products ordered to its customer to the delivery address. Shipping times are 24 hours maximum for products in stock and delivery times are 48 hours to 72 hours from shipment of the package unless otherwise indicated on the product sheet.

All products stipulated in orders placed with Phone Parts Online are intended for the personal use of customers or recipients whose name is mentioned at the delivery address.

Where applicable, the customer undertakes to pay upon receipt, all current and future taxes, duties and other charges due for the delivery of said products themselves; the joint and several liability of Phone Parts Online cannot be incurred at any time in this respect.

In the event of a delivery delay exceeding seven (7) days, the customer may, if he wishes, and except in cases of force majeure, terminate the sales contract by registered letter with request for acknowledgment of receipt. This right must, however, be exercised within sixty (60) working days from the delivery date initially stipulated in the contract.

Upon receipt of the ordered products, the customer or recipient must check that the delivered product is functioning properly.

In the event that one or more of the products ordered are missing or damaged, the customer or recipient must make any reservations with the carrier. You have 48 hours following receipt of the package to report a claim (via the “Contact” section on the site). After this period, no complaints will be admissible in the event of breakage during transport.

By opening your phone you automatically lose the manufacturer's warranty.

For reasons of availability of the products ordered, an order may be the subject of several successive deliveries to the customer.

In the event that the customer would like the products ordered to be delivered to two separate addresses, the latter should place 2 separate orders.

ARTICLE 6 - WITHDRAWAL

The customer has 14 days from receipt of the ordered products to return them to Phone Parts Online for exchange or refund. In this case, the customer must return the new, intact products, accompanied by all possible accessories, instructions for use and documentation.

In the event of exercising the right of withdrawal, Phone Parts Online undertakes to reimburse the sums paid by the customer, free of charge, with the exception of return costs and initial delivery costs.

Reimbursement is due within a maximum of 14 days.

ARTICLE 7 - PRICE

The price is expressed in € (Euro).

The price indicated on the product sheets does not include transport costs.

The price indicated in the order confirmation is the final price expressed all taxes included and including VAT. This price includes the price of the products, handling, packaging and conservation costs of the products, transport and commissioning costs.

ARTICLE 8 - PAYMENT

The price invoiced to the customer is the price indicated on the order confirmation sent by Phone Parts Online.

The price of the products is payable in cash by one of the payment methods offered on the site on the day of the actual order.

The order validated by the customer will only be considered effective when the secure banking payment center has given its agreement to the transaction and, where applicable, after acceptance of the assumption of risk by the insurer.

ARTICLE 9 - RESERVATION OF OWNERSHIP CLAUSE

The company remains the owner of the delivered goods from the day of delivery until full payment of the entire sale price, the risks of the goods nevertheless falling on the recipient, as soon as they are made available. .

Does not constitute payments, the delivery of drafts or any securities creating an obligation to pay.

Consequently, in the event of non-payment, the company is entitled to carry out or have carried out the recovery of the goods at the expense of the recipient.

This clause is an integral part of our general conditions of sale.

ARTICLE 10 - APPLICABLE LAW

These general conditions of sale are subject to the law of the United Arab Emirates.

ARTICLE 11 - LIABILITY

Phone Parts Online cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold.

The liability of Phone Parts Online will, in any event, be limited to the amount of the order. In the event of difficulties in the application of this contract, the customer and Phone Parts Online reserve the possibility, before any legal action, to seek an amicable solution.

Otherwise, for professional customers, the Dubai Commercial Court has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

ARTICLE 12 - GUARANTEE

In all cases, Phone Parts Online cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. The liability of Phone Parts Online is systematically limited to the value of the product in question determined on the date of its sale and without possibility of recourse against the brand or the company producing the product.

Phone Parts Online offers a 6-month legal guarantee in the event of an unexpected malfunction. This guarantee does not cover damage due to improper handling (breakage, torn tablecloths, etc.) or theft.

If the product is returned broken, scratched or showing abnormal signs of use, the warranty will be refused. The product will not be returned, exchanged or refunded. The costs of returning the product are your responsibility. The return of the repaired or exchanged product is the responsibility of phonepartsonline.com

Response: within 72 hours.

ARTICLE 13 - RETURN AND REFUND POLICY

Unsuitable product: You have a period of fourteen days (14) to exercise your right of withdrawal. This period begins from receipt of your product. If the product is returned open, incomplete, damaged or soiled, it will not be returned and no refund or exchange will be given. Return costs for this product are the customer's responsibility.

Product under warranty: If the product is returned broken, scratched or showing abnormal signs of use, the warranty will be refused. The product will not be returned, exchanged or refunded. The costs of returning the product are your responsibility. The return of the repaired or exchanged product is the responsibility of phonepartsonline.com

Product error: You have received a product that you did not order. The costs of returning this product are the responsibility of phonepartsonline.com and reimbursed upon receipt of the product if the after-sales service also notices the error.

Defective product: The customer undertakes to test the product received before complete installation and before removing the protective films. If the protective films are removed and the product has been installed without testing it before complete installation, the warranty will be refused. If you have followed the procedure and the product is defective upon receipt, the product will be exchanged or refunded. The costs of returning this product are the responsibility of phonepartsonline.com and reimbursed upon receipt of the defective product if the defect is actually noted by the after-sales service.

ARTICLES 14 - LEGAL INFORMATION

Providing personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide information results in non-validation of the Order.

In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL).

The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with Phone Parts Online. In addition, Phone Parts Online undertakes not to communicate, free of charge or for consideration, the contact details of its customers to a third party.
